Tax Year

The tax year is the calendar year in Portugal. However, a different tax year is permissible in certain specified cases.

Tax Return Filing

The tax return is required to be filed electronically by taxpayers until 31 May of the following calendar year. For taxpayers with a tax year not corresponding to the calendar year, the deadline is before the end of the fifth month, subsequent to the closing date of the tax year. For the calendar year 2022, the tax return filing deadline is extended to 6 June 2023 without any penalties.

Taxpayers are also required to file the supporting annual tax and accounting information statement by the 15th day of the seventh month following the close of the tax year.

Tax Payments

Tax is generally prepaid in three instalments, in July, September, and December (or the seventh, ninth and twelfth month for entities adopting a tax period other than the calendar year). Such prepayments are calculated as 80% (95% for taxpayers with a turnover exceeding EUR 500,000) of the preceding tax year's corporate tax liability. A final instalment is required to be paid by 31 May of the following calendar year at the time of filing the tax return. This final instalment is required if the total tax paid in the previous instalments is less than the tax liability determined by the taxpayer through a self-assessment. For the calendar year 2022, the final instalment deadline is extended to 6 June 2023 without any penalties.

Prepayment of tax is not required if the previous year's assessed tax is less than EUR 200.

The special prepayment is repealed effective 28 June 2022. Previously, there was an obligation to make a special prepayment in March or in two equal instalments, in March and October (or in the third and tenth months, for entities adopting a tax period other than the calendar year). The special prepayment was calculated as 1% of the preceding year's turnover with a minimum of EUR 1,000; if such amount exceeded EUR 1,000, the special prepayment required to be made would equal to EUR 1,000 plus 20% of the excess, up to a limit of EUR 70,000. Similar to ordinary prepayments, special prepayments were deductible from the taxpayer's final corporate income tax liability.

Also, supplementary prepayments are payable by entities obliged to make prepayments, to the extent that they were subject to the State surcharge (see Sec. 8.1.) during the preceding period. Such payments are due on the same dates as the prepayments mentioned above.

From 1 January 2018, where no tax return is filed, tax payments are required to be made by 30 November of the year following the year the tax pertains to or by the end of the sixth month following the end of the time period for submitting the said tax return, subject to certain conditions.

Special Payment Regime

Effective 1 January 2021, the following special payment regimes are introduced for the year 2021:

The payment of outstanding corporate tax in instalments for qualifying micro, small and medium enterprises without the requirement of a guarantee and with a 50% reduction in the collection of compensatory interest or any other charges or charges during the period of the instalment plan, which is to be paid by 31 December 2021;
A general option to request payments in instalments of debts to the tax and customs authority with some relaxed conditions; and
A general option to request payments in instalments of social security debts with some relaxed conditions.

Availability of E-Filing

E-filing is mandatory for corporate tax returns and is available on the tax authorities’ dedicated portal (https://www.portaldasfinancas.gov.pt/at/html/index.html).

Annual Simplified Business Information Return (IES)

The simplified business information return is to be filed annually on the finance portal by 15 July or the 15th of the seventh month subsequent to the end of the tax year.
