Tax Year

The standard tax year in Romania is the calendar year from 1 January to 31 December. From 2014, alternate tax years are possible.

Tax Return Filing

Generally, 3 quarterly tax declarations are required to be submitted by the 25th of the month following the 1st, 2nd, and 3rd quarters. The annual tax return is due by 25 March (or the third month if using an alternate tax year) following the close of the tax year.

Non-profit organizations and certain agricultural companies are required to submit annual tax returns by the 25 February following the close of the tax year.

Taxpayers must also submit a withholding tax statement by the last day of January following the close of the tax year regarding tax withheld on payments to non-residents.

For the tax year 2021-2025, the deadline for submitting annual corporate tax returns for taxpayers subject to Order 1802/2014 is extended to 25 June of the following year or the 25th day of the 6th month following the end of the revised tax year.

COVID-19 Emergency Measures

In response to the COVID-19 pandemic, Romania extended the deadline for filing the annual tax return for the tax year 2021 until 25 June 2022. The extended deadline applies until the tax year 2025.

Further, entities that are registered as temporarily inactive or suspended in the trade register are not required to submit tax returns during the period of suspension. Such entities are required to start filing the tax returns when they resume activity or on expiry of 3 years from the date mentioned in the trade register as temporarily inactive or suspended.

Tax Payments

Taxpayers are generally required to make 3 quarterly tax payments by the 25th of the month following the 1st, 2nd, and 3rd quarters. The final balance payment is due by the 25th of the third month following the close of the tax year, along with the annual tax return.

The quarterly prepayments are based on the actual income of the quarter. However, taxpayers may also apply to base the 3 quarterly payments on the previous year's tax liability increased by the consumer price index (CPI) inflation rate. The final tax payment based on the actual income for the year is due following the close of the tax year, along with the annual tax return. If this method is chosen, it must be applied for at least 2 years.

For the tax year 2021-2025, the deadline for corporate tax payment for taxpayers subject to Order 1802/2014 is extended to 25 June of the following year or the 25th day of the 6th month following the end of the revised tax year.

Taxpayers with tax liabilities exceeding RON 300 million may reschedule the payment of such liabilities (subject to certain conditions) in instalments over a period of 5 years.

Tax Amnesty

The Romanian government adopted a series of measures for the collection of unpaid taxes and provided a tax amnesty program for outstanding taxes as on 31 August 2024. The tax amnesty is available for all taxpayers, including natural and legal persons, regardless of the form of ownership. The tax amnesty program includes the following:

A bonus (discount) of 3% of the annual corporate income tax and microenterprise income tax for taxpayers who declare and pay their annual corporate income tax or microenterprise income tax for the year 2024 or for the amended fiscal year starting in 2024. The amounts resulting from the 3% bonus are not refunded but rather used to offset a taxpayer's future tax obligations;
Interest and penalties associated with unpaid taxes as on 31 August 2024 are waived, provided that the unpaid tax amount is paid in full by the date of submission of the application but no later than 25 November 2024;

Interest and penalties associated with the tax liabilities due as on 31 August 2024 are waived if the unpaid tax is paid as of that date, subject to the fulfilment of certain conditions.

For tax liabilities payable before 31 August 2024, interest and penalties associated with an increase of the same as a result of corrective statements are waived, provided the corrective statement is submitted starting with 1 September 2024 until the date of submission of the request for cancellation of interest and penalties, but no later than 25 November 2024; and
Interest and penalties associated with additional tax liabilities established as a result of a tax audit are waived if the additional tax liability is paid within the allotted time frame and an application for the cancellation of the penalty or interest is filed within 90 days from the date of communication of the tax audit decision.

Partial waivers are also available in certain cases where partial payment is made.

Availability of E-Filing

Forms, including declarations and returns, can be filed electronically via the Romanian e-guvernare portal.

Effective from 1 January 2018, e-filing of income tax returns is mandatory.
