China's State Administration of Taxation has instructed local tax bureaus throughout the country to report on companies that have made service fee or royalty payments to related parties between 2004 and 2013. The statute of limitation for transfer pricing adjustment in China is 10 years.
Taxpayers in China that have made or are making such payments should be sure to have documentation prepared to substantiate both the arms length pricing and the economic substance of such transactions.
