On 8 January 2019, the European Commission announced the adoption of two decisions recommending that Italy and Spain align their taxation of ports with State aid rules. While not a formal decision on non-compliance with State aid rules, the Commission has taken the preliminary view that the existing regimes provide ports with a selective advantage that may be in breach of the rules.
