Greece Supreme Administrative Court Holds Customs Penalty Unconstitutional and in Breach of the EU Principle of Proportionality

Greece’s Supreme Administrative Court, in its Decision No. 668/2025 of 23 April 2025, has annulled the flat-rate customs penalty of EUR 100 levied under article 42(2) of the Greek Customs Code (Law 2960/2001), finding that in absence of any statutory ceiling, the measure can lead to excessive sanctions that are not proportionate to the gravity of the infringement.
