VAT Not Applicable for IP Sales to Russian Companies for Use Outside Russia

The Federal Tax Service has recently clarified the application of value added tax (VAT) for the sale of intellectual property (IP) by a foreign company to a Russian company if the IP is used outside of Russia.

Under Russian law, VAT on IP sales is based on the rules for supply of services. Under the rules, no VAT will be applicable as long as the IP is used exclusively outside Russia, and the foreign company has no permanent establishment in Russia.
